License to Use the App:

The App is licensed, not sold, to you for use only under the terms of these Terms of Use. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.

You agree to use the App only for lawful purposes and in accordance with these Terms of Use. You agree not to use the App:

The App may allow you to submit, upload, publish, or otherwise make available content, including but not limited to text, usage details, and photographs (collectively, "User Content"). You retain all rights in and to your User Content.

By making any User Content available through the App, you grant to the Company a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the App and the Company's business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

User Conduct:

You understand that all User Content, whether publicly posted or privately transmitted, is the sole responsibility of the person from whom such User Content originated. This means that you, and not the Company, are entirely responsible for all User Content that you make available through the App.

The Company does not control, endorse, or approve User Content and makes no representations or warranties of any kind with respect to User Content. The Company does not guarantee the accuracy, integrity, or quality of User Content, and under no circumstances will the Company be liable in any way for any User Content or for any loss or damage of any kind incurred as a result of the use of any User Content made available through the App.

Proprietary Rights:

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by the Company, its licensors, or other providers of such material and are protected by local and international laws and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms of Use permit you to use the App for your personal, non-commercial use only. You hereby acknowledge that any other use of the App is strictly prohibited and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from the App. You also agree not to access or attempt to access the App's source code, reverse engineer the App, or use any device, software, or routine to interfere or attempt to interfere with the proper functioning of the App. Any unauthorized use may result in the termination of your license and the pursuit of legal action.

Disclaimer of Warranties:

The App is provided on an "as is" and "as available" basis. The Company makes no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, or products included in the App. You expressly agree that your use of the App is at your sole risk.

The Company does not warrant that the App will be uninterrupted or error-free, and the Company will not be liable for any interruptions or errors. The Company also does not warrant that the App or its server will be free from viruses or other harmful components.

Limitation of Liability:

The Company will not be liable for any damages of any kind arising from the use of the App, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Indemnification:

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms of Use or the Privacy Policy, or any activity related to your use of the App (including but not limited to infringement of third parties' intellectual property rights, negligent or wrongful conduct) by you or any other person accessing the App using your account.

The Company reserves the right to modify these Terms of Use at any time. Your continued use of the App following the posting of any changes to these Terms of Use constitutes acceptance of those changes.

Termination of Use:

The Company may, in its sole discretion, at any time terminate or suspend all or a portion of the App, or your use of all or a portion of the App, with or without notice and with or without cause.

General Terms:

These Terms of Use and the Privacy Policy constitute the entire agreement between you and the Company with respect to the use of the App. If any provision of these Terms of Use is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
